SHAH ALAM: Kajang municipal councillor Tan Boon Wah told the inquest into the death of Teoh Beng Hock today that he did not hear any screaming nor did he see anyone being beaten throughout the period he was held at the Malaysian Anti-Corruption Commission (MACC) office here.

Tan, 40, who was questioned by the MACC on the same day as Teoh, said he was able to move freely to go to the toilet or to get a drink before and after the questioning process.

He told the inquest that he was picked up from his house at 8pm on July 15 last year and was freed the next day at 3pm.
Tan, a businessman, said he saw the Selangor executive councillor’s political aide at 5am while walking towards the toilet.

“I saw him pacing about in the pantry, looking at the floor. I asked him, ”Teoh, you are still here?”, and he looked at me but said nothing. Then I went to the toilet,” he said. Tan, under examination by Deputy Public Prosecutor Mohd Abazafree Mohd Abas, who is assisting the coroner in the proceeding, also said that Teoh was not injured and had not complained of anything.

Teoh, 30, was found dead on July 16 last year on the fifth floor of Plaza Masalam here after testifying at the MACC office on the 14th floor of the same building over alleged irregularities in the disbursement of state funds.
Asked by MACC chief prosecutor Datuk Abdul Razak Musa whether on the night he met Teoh he had scolded him for causing him (Tan) to be called by the MACC, Tan said, “No”.

He denied that he was angry at Teoh for dragging him into the issue concerning the claims for the purchase of flags in conjunction with the National Day.

He also denied that he was angry at the MACC for causing him to pay RM20,000 after he lost in his suit against the commission.
Tan appeared emotional at some stage during the examination by Abdul Razak and could be heard raising his voice when Abdul Razak told him to answer his questions seriously and accurately.

Coroner Azmil Muntapha Abas also told him to be more focused.

When put by Abdul Razak that he (Tan) had actually bumped into Teoh at 2.30am and not 5am as claimed by him, Tan said, “No.”

He also denied yelling at Teoh “Ini semua lu punya pasal” (This is all because of you) inside the toilet as claimed by Putrajaya MACC Deputy Superintendent Bulkani Paharuddin in his testimony during the earlier stage of the inquest.

Tan, however, did not deny that Teoh had asked him to supply flags through a company owned by his (Tan’s) wife and that the MACC had picked him up for questioning over the matter.

Earlier, to a question from Teoh’s family lawyer Gobind Singh Deo, Tan said MACC officers had questioned him for four hours and that he remained in the standing position during the process.
He also said that he was questioned in a rough manner.

Testifying in Malay, Tan said: “Ada pegawai yang cucuk muka saya dan cakap ”you tak faham bahasa ka?”,”you dari China ka”, ”macam ni ka ahli majlis”.”

(“An officer came and poked my face and said ”you don’t understand?”, ”are you from China?”, ”is this how a councillor behaves?”.)

He said that at that time there was a question why he, who was earlier said to be a witness, was question in such manner.

Tan said that after the four-hour questioning, he was allowed to get water to drink from the pantry and was allowed to sleep at 2.45am.

He said he went to the toilet at 5am and another time at about 7am.

To a suggestion by Abdul Razak that he made up his claim about him being in standing position when he was question by MACC officers, Tan said, “No.”

Earlier at the outset of today’s proceeding, Azmil rejected the application by Abdul Razak to call witnesses in relation to the invoice printed from Teoh’s laptop computer. – Bernama

GEORGE TOWN: Having picked a fight with the chief secretary to the government and his state development officer, Chief Minister Lim Guan Eng is now training his guns on the media.

Lim, who is also DAP secretary-general, said he planned to seek legal advice against certain newspaper reports on his spat with state development officer Nik Ali Mat Yunus.

Claiming that negative remarks that might tarnish his image had been printed, he was quoted by Bernama as saying that he hoped the mainstream media would publish their reports accurately without bias.
Lim and Nik Ali are involved in an unprecedented public spat after the chief minister hit out at the SDO on three occasions.

He has accused Nik Ali of being incompetent, useless, unprofessional, a coward and called for his sacking.

The chief minister had all this while claimed that Nik Ali had failed to make seating arrangements for him at the launch of the Penang Hill railway project and blamed him over the arches at the Botanical Gardens and sand theft in Balik Pulau.
Nik Ali subsequently hit back at Lim and said the chief minister’s statement smacked of impertinence and it was unbecoming for him to say such things.

He said Lim had attacked him over the issue of a seat.

During his press conference yesterday, Lim was asked by reporters to comment on the seating issue.
However, Lim challenged reporters to show him proof that he had accused Nik Ali of not providing him with a seat during the Penang Hill function.

He issued the challenge after he was shown a newspaper clipping with a picture of him seated among VIPs at the function.

After seeing the picture, Lim immediately retorted that the issue between him and Nik Ali was not about seating arrangements.

At this point, a journalist said he had indeed raised the issue previously but Lim shrugged it off and said he had

only raised issues concerning sand theft, Penang Botanical Gardens arches and construction of the air force college.

Lim’s explanation, however, contradicts the sequence of events leading up to his spat with Nik Ali.

Nik Ali openly went against Lim on Monday but Lim only raised the air force college issue on Tuesday, after his spat with Nik Ali escalated.

Meanwhile, when asked to comment on Lim’s apparent change of tune, state opposition chief Datuk Azhar Ibrahim said it was unbecoming of Lim to continuously lie to the people of Penang.

He said Lim’s attitude, as the chief executive of the state, was highly disgraceful.

He also said it was pathetic that Lim could not see his own faults but constantly pinned the blame on others.

“I was also at the Penang Hill function and Lim came late .

“There was definitely a seat reserved for him there and it is unbecoming of him to blame Nik Ali for something that is not true.”

Azhar said Lim should concentrate on bigger issues like developing Penang instead of getting involved in petty squabbles with everyone.

KUALA LUMPUR: Capitalism must be very carefully handled although it is a good system, said former Prime Minister Tun Dr Mahathir Mohamad.

Dr Mahathir said events that led to the present global financial crisis, which affected the West very much showed that uncontrolled capital could actually destroy even the big economies.

Capitalism has many different interpretations, some declare it as complete free movement of capital into a country to invest and exploit while others feel that there should be some control over the movement of capital.

“Because capital is a very powerful instrument…it actually can destroy an economy as much as it can build an economy. Many countries now especially in Asia are wary of complete free flow of capital,” he said from Sarajevo, Bosnia-Herzegovina, in a question and answer session about the future of capitalism, in a video conference interview.

The session was conducted by Dr Frank-Jurgen Richter, the President and founder of Horasis: The Global Visions Community, an independent international organisation committed to enacting visions for a sustainable future, in conjunction with the Plus International Expressway Conference and Exhibition 2101, which ended here today.

Talking further about the cause of the present financial crisis, Dr Mahathir who is in the capital city of the Balkan state for a visit, said that governments in many countries abdicated their role because they decided that the market will control the economy and the market would play the role of regulating itself.

“But the market is about making money. So, when they saw a chance to abuse the system to get money for themselves…they did not hesitate,” he said.

As such, Dr Mahathir said that governments need to regulate the functions of banks and make sure banks did not lend far too much money.

“The crisis started because too much capital (was) lend out without any proper consideration as to the prudence of lending money to the people, who actually turned out unable to pay their debts,” he said.

Answering a question on the rise of protectionism in the United States and Europe, Dr Mahathir
pointed out that most countries in the world including East Asia had the tendency to protect certain industries regarded as of national character or very crucial to the economic growth of their country.

“So we had to accept that there cannot be really total openness…some countries will try to protect not by tariffs or physical blockage but by having certain conditions such as qualities…specification, etc…which means in effect you have become protectionist,” he said.

On China, Dr Mahathir urged those who had the idea that China posed a threat to the world, to re-think about it.

“Because China is there and will be there, no matter what you do, and is going to be a great world power…but I think to curb China’s growth and all that is not the right approach.

“You have to accept that China is going to be very strong economically and strong economies obviously must have strong military capability to protect themselves. This is not a threat to the world,” said Dr Mahathir.- Bernama

FUZIAH Salleh (PKR-Kuantan), in bantering with reporters at the Parliament lobby yesterday on the Pakatan Rakyat’s choice of candidate for the Hulu Selangor parliamentary by-election, begged to differ with the prime minister’s evaluation that the polls would not reflect the overall sentiment of voters.

She, like the Umno and MIC leaders squabbling over candidate selection, had missed the point because there are more profound parameters at play here.

Whatever horse trading takes place over who should represent Barisan Nasional in the by-election in three weeks time is inconsequential — the BN candidate is vaunted to reflect the values of 1Malaysia.

In that sense, the Umno-MIC bickering, at least at the grassroots is understandable. Umno feels strongly that its candidate (read Malay) has a better chance of winning, given the sentiments on the ground attached to the late PKR incumbent Datuk Dr Zainal Abidin Ahmad.

However, the MIC asserts that coalition comradeship dictates that MIC deputy president Datuk G. Palanivel regains the opportunity to avenge his narrow defeat to Zainal Abidin in the 2008 general election.

What the MIC is thinking privately but which everyone is saying out loud is that Palanivel’s candidacy and hopeful victory epitomises the party’s desperation — it needs this contest more than anything else.

While the Umno demand assesses the short term, Datuk Seri Najib Razak, who is the final arbiter in the candidate selection, has shown that in envisioning the bigger, long-term picture, an MIC candidate is pliable, even if the consequence may lead to a defeat on April 25.

How so? As prime minister and BN chairman, Najib plays chess, perhaps playing the master game of his political life.

He knows that to win the next general election slated before 2013, the more pivotal goal, he has to revitalise BN and scrape its unredeemable legacy while maintaining its practical values.

To do so, he is mixing strengths, weaknesses, problems, crises and idiosyncrasies in a single blender that produces a pragmatic balance.

Former prime minister Tun Dr Mahathir Mohamad’s philosophical approach to resolving racial concerns, and that included BN’s perennial wrangles, employed this novel approach — he would simply ask each race or representative if they were satisfied with their lot and all of them, inevitably, would claim loudly that they were not.

Dr Mahathir’s quirky response: “Then it means that I have been fair.”

Had one race or representative claimed that they were satisfied, then the ex-PM would have realised that Malaysia was in real trouble.

Inspired by that innovation, Najib would have sensed that the by-election is only a pit stop to assess the BN dynamics, whether its machinery has the stamina and wherewithal for the hard drive towards 2013.

To pundits understanding Najib’s farsightedness, winning Hulu Selangor would be a pleasant bragging right but losing allows the BN the more valuable opportunity to tweak the machinery for the long haul. Either way, it does nothing to the balance of power in the Dewan Rakyat.

Najib is unlikely to waste time reviewing all the considerations that led to the BN’s defeat in 2008, already ancient political history in his mind.

What’s current and urgent is the push for 2013 and winning the general election — a far more determined objective.

KUALA LUMPUR: Sungai Petani member of parliament Datuk Johari Abdul will not apologise to his Parti Keadilan Rakyat comrade and Bakar Arang (Kedah) state assemblyman Tan Wei Shu as the latter’s allegations against him are baseless.

Johari told the New Straits Times yesterday that he would give Tan enough time to compose himself after being dropped from the influential state executive council.

Johari said there was no reason why he should apologise to Tan, who was dropped from the Pas-dominated state executive council on March 10, as the latter had not provided evidence for saying that he (Johari) had tarnished his image.

“If he (Tan) has proof of my (negative) statements against him, present them and then we can talk about it. It is just like a court trial, if you say I had hit you on the head, you have to provide the date, time and place of the alleged incident.

“You cannot simply make general statements,” Johari said when contacted yesterday.

He added that he would give Tan the benefit of the doubt and some time for the first term assemblyman to “adjust himself” after being dropped as an state executive council member.

Tan had recently accused Johari of spreading lies about him and tarnishing his image as an elected representative, saying that he (Tan) had not lived up to PKR supremo Datuk Seri Anwar Ibrahim’s expectations and that of the people in his constituency, which led to his eventual exclusion from the state executive council.

Kulim assemblyman Lim Soo Nee, who came to Tan’s defence, had also warned Johari against making derogatory statements against Tan during a PKR function in Kedah.

Following this, Tan has demanded Johari, and certain PKR leaders at the national level, to apologise to him for the damaging remarks.

Tan was replaced by PKR’s Sidam assemblyman Tan Show Kang in the state executive council and the sudden move has drawn widespread criticism from the Chinese community leaders as Show Kang, a vegetable farmer, was seen to be unfit for such a high ranking government position.

In an exclusive interview with the NST on Saturday, Tan had branded Johari as a “crocodile head” and “warlord”, who had been using his rank and power to dictate to state assemblymen in his parliamentary constituency according to his whims and fancies.

He said Johari has been using certain PKR leaders, who were also supreme council members, to “cook up things” against him so that he would be removed from the party.

Similar to earlier revelations by Kulim Bandar Baru MP Zulkifli Noordin, Wangsa Maju MP Wee Choo Keong and Nibong Tebal MP Tan Tee Beng, the two disgruntled PKR Kedah assemblymen have also labelled the group as “little Napoleons” who could destroy the party.

Tan also lamented that his complaints on the lack of cooperation among Pakatan Rakyat leaders in Kedah had fallen on deaf ears.

Yesterday, Zulkifli told the NST that he and the rest of his friends were referring to “almost the same people” in PKR who had “delusions of grandeur”.

Zulkifli, who was sacked from PKR recently over controversies surrounding the “Allah” issue, said the little Napoleon group were confident that they would capture Putrajaya in 2013 and had no qualms about “removing” those not in line with them along the way.

The independent MP acknowledged that no action was taken against Tan’s complaints on the situation in the state government, although Tan had been raising them in the party meetings and seminars ever since he was elected as the state assemblyman.

“Tan’s problem is the same like (Lunas assemblyman) Mohd Radzhi Salleh, (Behrang assemblyman) Jamaluddin Mohd Radzi and (Changkat Jering assemblyman) Osman Jailu. Nobody cared to listen to their complaints.

“As long as they (little Napoleons) think that you are not toeing their line, they will sideline you and find ways to discredit you through character assassination. They do not do it based on facts or substantive arguments,” Zulkifli said.

He added that the elected representatives, including him who were recently sacked from PKR, had no other choice but to take issues outside the party as they had no mechanism to voice their problems.

“The fact that Wangsa Maju MP had to raise these matters in Parliament showed how serious the problems are. Anwar is surrounded by the ‘little Napoleons’ who have formed a wall around him that others cannot penetrate.

“Even the party’s mouthpiece Suara Keadilan and information machinery are being controlled,” he said.

While debating the Royal Address last month, Wee had warned the “little Napoleons” not to force him to expose their “politics of deceit and politics of expediency” and criticised the culture (of little Napoleans) of using any means to defame political leaders for political gain.

Zulkifli said Anwar was surrounded by the same “morons” prior to 1998, who had influenced the former deputy prime minister to follow their agenda and eventually led to his downfall from the government.

KUALA LUMPUR: Kelantan prince Tengku Muhammad Faris Petra yesterday withdrew his suit against his brother and two others over the announcement on the termination of his position as the regent.

His lawyer Zainur Zakaria made the withdrawal application when the case was mentioned before High Court (Appellate and Special Powers) judge Datuk Aziah Ali in her chambers.

In the suit filed on March 30, Tengku Faris was seeking a declaration that the appointment of the state’s council of succession former chairman, Tengku Abdul Aziz Tengku Mohd Hamzah, as the regent was invalid.

He named Tengku Muhammad Fakhry Petra, sultan of Kelantan’s private secretary Datuk Wan Hashim Wan Daud and Tengku Abdul Aziz as defendants.

Besides Tengku Faris, the state government and the state secretary were the plaintiffs.

They also wanted the court to declare that the “declaration” allegedly by the sultan which was announced by Wan Hashim and Tengku Abdul Aziz on March 24 was null and void.

The announcement was on the termination of Tengku Faris’ position as the regent.

Yesterday, Wan Hashim’s counsel Gobind Singh Deo said that no grounds were given by the plaintiffs for the withdrawal of the suit.

“We reserve our right to take up issues of abuse of process if the need arises,” he said.

Tengku Fakhry was represented by counsel Datuk Mohd Haaziq Pillay while counsel Nizam Bashir appeared for Tengku Abdul Aziz.

The plaintiffs were also asking for a declaration that the defendants did not have any power or authority to represent and/or act for the sultan in relation to state affairs.

They also wanted an injunction to stop Tengku Abdul Aziz from representing or claiming himself to be the Kelantan regent and from disturbing or interfering in the implementation of his duties.

KUALA LUMPUR: Information Communication and Culture Minister Datuk Seri Dr Rais Yatim said he was shocked at the change in the stand of former finance minister, Tengku Razaleigh Hamzah maintaining that Kelantan had the right to receive oil royalty.

Rais said Tengku Razaleigh’s statement on Thursday that the Kelantan state government should now get the oil royalty instead of compassionate payment was contradictory to his statement in October 2000, and his latest statement had confused the people, especially those in Kelantan.

Rais said this to Bernama when asked to comment on Tengku Razaleigh’s statement on the oil royalty issue in his speech at the special prayers and special ceramah on the petroleum royalty at the Stadium Sultan Mohamed IV, Kota Baharu, Kelantan on Thursday, which was also attended by Kelantan Menteri Besar Datuk Nik Abdul Aziz Nik Mat.

On Oct 31, 2000, the media had quoted Tengku Razaleigh as saying that in terms of the law, states in peninsular Malaysia did not have any right on the oil found outside the jurisdiction of their administration.

As such, Tengku Razaleigh, who as Petronas Chairman in 1974 was involved in the agreement on the payment of compassionate payment to the state governments concerned, including Terengganu and Kelantan, said the payment of oil revenue by Petronas to the state governments concerned was not given because there was a policy that it was the right of the state concerned. Tengku Razaleigh had made the statement in response to the dispute by PAS State Assemblymen on the compassionate payment at the State Legislative Assembly sitting.

Rais said Tengku Razaleigh’s statement in 2000 was very clear that all states in the peninsula did not have any right under the Petroleum Act 1974, and “when Ku Li changed his stand two nights ago, it is most surprising how he could change his actual stand expressed in late October 2000 in front of thousands of people.”

“For states thinking of making claims on the oil royalty as Kelantan is doing, they have no right under any Petroleum Act as they (oil wells) are in international waters where the Federal government had the right.

“This is the position of the international law as well as the national law. The Petroleum Act is different from the provisions under the Continental Shelf Act where Sabah and Sarawak are subjected to,” he said, adding that Tengku Razaleigh’s statement was most confusing.

“I did not expect he could ignore Umno’s official stand because he is collaborating with the opposition pact in Kelantan. This situation is also confusing to the Umno members.

“It will not be a problem if he wants to be an intermediary, but I hope he will not submit views and opinions on behalf of PAS and the opposition parties because he is still the Gua Musang Umno division head, and I hope the people understand the actual situation,” he said. – BERNAMA

GEORGE TOWN: The Penang DAP-PKR tiff is catching fire with Penang DAP chief Chow Kon Yeow describing Datuk Seri Zahrain Mohd Hashim as being politically frustrated.

He said there was no doubt that the PKR Bayan Baru MP was unhappy over his removal as state party chairman and was now attempting to break up the Pakatan Rakyat coalition here.

Chow claimed he had been informed by Chief Minister Lim Guan Eng that Zahrain was frustrated as he (Lim) had refused to endorse the MP’s decision to award tender for the privatised management of the Bukit Jambul Golf Club to a RM2 company.

“Zahrain may want to personally burn his bridges with us but he shouldn’t allow his political frustrations to break up Pakatan Rakyat in Penang,” he told a press conference at the party’s headquarters here on Saturday.

On Zahrain calling Lim a communist-minded dictator and chauvinist, he said this was a baseless, racially-motivated lie.

“Even Umno and Barisan Nasional never labelled Lim a communist when he was detained under the ISA in 1987,” he added.

Earlier, Deputy Chief Minister I Mansor Othman, who is the state PKR chairman, said the party’s central committee would meet today to discuss Zahrain’s outburst.

He said the party would announce the outcome of the meeting – whether action would be taken against Zahrain or otherwise – on Tuesday.

He said while the party allowed leaders to make criticism, it would not tolerate name-calling in the press.

When contacted, Zahrain said he “could not be bothered” with what the DAP had to say as he always spoke his mind.

“We cannot compromise on PKR principles just because we want to work with them. Lim is not qualified to be chief minister.

“I spoke to many people including party members and non-governmental organisations who all agreed that Lim is a dictator so I am not retracting my statement,” he said adding that he was prepared to face any action by his party, even sacking.

He also denied any involvement in the issuance of the tender for the Bukit Jambul Golf and that “if anyone implies otherwise, I won’t hesitate to sue.”

It was reported on Friday that dissension within Pakatan had spread, and the simmering feud between DAP and PKR leaders broke into the open when Zahrain verbally attacked Lim.

KUALA LUMPUR: PKR Bayan Baru MP Datuk Seri Zahrain Mohamed Hashim’s open criticism against Penang Chief Minister Lim Guan Eng is loaded with facts which must be investigated and acted upon by Pakatan Rakyat. PKR Kulim Bandar Baru member of parliament Zulkifli Noordin said Zahrain’s outburst was not without basis and that it was an open secret among PKR, Pas and even DAP leaders in Penang.

“What Zahrain had said is true. Lim cannot accept criticism and does not tolerate any views other than his. I myself have experienced this.

“He won’t listen to anyone’s views, except maybe to very few in his inner circle. Even some of the local DAP leaders in Penang are unhappy with his style, but they have no choice but to tolerate him.”

Zulkifli reiterated his view that DAP was merely riding on PKR and Pas to achieve their (DAP’s) own narrow agenda.

“I’ve said this many times, the DAP is a Chinese chauvinist party.

“They try to portray themselves as multiracial by placing one or two non-Chinese here and there but basically they are Chinese dominated and are in Pakatan Rakyat solely to achieve their own agenda,” he said when contacted yesterday.

Zulkifli who is himself under investigation by PKR’s disciplinary committee for his outburst against his party and DAP, warned that the issue would ‘explode’ if PR leaders continued to sweep the matter under the carpet.

“People like me have been labelled (for speaking out), but for someone so soft-spoken like Zahrain to say something like this, now that’s different.”

Asked if his style of speaking his mind and even criticising fellow colleagues openly might have triggered other leaders to do the same, he said, “We are just voicing out the things which are not right, the feelings of the grassroots”.

Zulkifli said that Zahrain doesn’t have any other avenue to voice his views as he had been removed as the PKR Penang chairman.

Meanwhile, PKR Selangor state executive councillor Dr Xavier Jayakumar was of the opinion that Zahrain should have gone through the proper channels in the party for an explanation on issues bothering him.

“I think this type of outburst against the Penang chief minister and a PR colleague should be controlled and they should also refrain from going to the press with it.

“There will always be contentious issues among us, but that is part and parcel of a politician’s life.

“We should learn to refrain from issuing public statements and act in a more professional manner.”

Asked if the party will take any action against Zahrain, he said it would be discussed at the party meeting.

“Anyone who feels that they have been wrongly judged can also use the avenues in the party to explain.”

The reports were lodged by the poverty eradication foundation chairman Datuk Zainal Abidin Sakom, chief executive officer Zulkhairi Jamaluddin and trustee Bing Selamat Amir at the district police headquarters.

In his report, Zainal urged the police to investigate the media statements made by Khalid.

Zainal said the statements were ill-intended and political in nature, among others.

He said the allegations by Khalid were untrue, adding that many in YBK felt that there was a move to tarnish the 20-year-old foundation’s name.

Asked why YBK was not filing a suit, Zainal said its lawyers would monitor police investigations before deciding on their next step.

He also feared that the state may decide to seize YBK’s 312ha building in Serendah worth about RM42 million because the foundation has not paid RM5.7 million in quit rent for the land.

The land was alienated to YBK in 1995 by former menteri besar Tan Sri Muhammad Muhammad Taib.
